1. Service Cancellation
Cancellation Conditions:
• Cancellation requests must be submitted in writing via email.
• Services already delivered, initiated, or completed may not be eligible for cancellation.
• Ongoing projects may be cancelled subject to work completed and expenses incurred.
2. Refund Eligibility
Refunds may only be considered under the following circumstances:
• Duplicate payment made by the customer
• Payment charged but service not initiated
• Approved cancellation before commencement of work
• Hosting services remaining completely non-functional for more than 30 continuous days after valid complaint submission and technical verification
All refund requests are subject to review and approval by our management and technical team.
3. IT Project, NDA & Payment Default Policy
- Once the NDA (Non-Disclosure Agreement), proposal, quotation, work order, or project agreement is signed and the project work has commenced, the project shall be considered officially active.
- In case the client stops the project midway, delays communication, fails to provide required approvals, or fails to make scheduled payments, the company reserves the right to:
- Suspend ongoing work immediately
- Hold project files, source code, server access, and deliverables
- Terminate the project after 30 days of non-payment or inactivity
- Any outstanding unpaid amount shall continue to remain legally payable by the client.
- An interest of 12% per annum may be charged on overdue invoices, pending payments, or delayed milestones until the outstanding amount is fully cleared.
- Any advance payment, setup charges, development charges, or completed work performed before project suspension or termination shall be non-refundable.
- Upon termination due to non-payment, the company shall not be responsible for:
- Data loss
- Service interruption
- Project delays
- Third-party subscription expiration
- Hosting suspension
- Domain or server expiry
- The company reserves full rights to take legal or recovery action for pending dues, unpaid invoices, or breach of agreement where applicable under Indian law.
4. Non-Refundable Services
The following products and services are strictly non-refundable:
• Domain registration and renewal
• Web hosting renewal charges
• SSL certificates
• Third-party software licenses
• Digital marketing expenses already incurred
• Website development after project initiation
• Custom software or application development
• Consultation and support services
• Graphic design and branding services
• Server setup and configuration charges
• Email hosting services
• Annual maintenance services
5. Technical Support & Service Issues
• Technical support shall be provided according to the selected service plan.
• Customers must report issues through official support channels.
• Our technical team will investigate and attempt to resolve all valid issues within reasonable timeframes.
Refunds shall not be provided for:
• Temporary downtime
• Technical glitches
• Third-party server/network failures
• Plugin or theme conflicts
• User-side misconfiguration
• Browser/device compatibility issues
• Delays caused by domain propagation
• Cyber-attacks, malware, or hacking incidents
• Errors caused by third-party integrations
6. Hosting Services Policy
Hosting services are provided on a best-effort uptime basis.
The customer understands and agrees that:
• Scheduled maintenance may temporarily affect availability.
• Minor interruptions or downtime do not qualify for refunds.
• Customers are responsible for maintaining backups unless backup services are specifically included in the package.
7. Hosting Refund Conditions
Refunds for hosting services shall only be applicable if:
• The hosting service remains completely inaccessible or unusable for more than 30 continuous days, and
• The issue is verified by our technical team as originating solely from our infrastructure.
No refund shall be provided for:
• Partial outages
• Slow website speed caused by website coding
• Resource overuse
• Traffic spikes
• Suspension due to policy violations
• Issues caused by third-party software or scripts
8. Partial Refunds
For projects cancelled after work commencement:
• Refunds, if applicable, shall be calculated based on incomplete work only.
• Administrative, processing, manpower, and resource utilization charges may be deducted.
9. Chargebacks & Payment Disputes
Customers are requested to contact us before initiating any chargeback or payment dispute.
Fraudulent or unjustified chargebacks may result in:
• Immediate suspension of services
• Permanent termination of account access
• Legal recovery proceedings where applicable
10. Domain & Hosting Renewals
• All renewal payments are non-refundable once processed.
• Customers are responsible for renewing services before expiry dates.
• We are not liable for domain expiration, downtime, data loss, or business interruption caused by delayed renewals or customer negligence.
11. Limitation of Liability
Bankonite Communications Private Limited shall not be liable for:
• Business loss
• Revenue loss
• Data loss
• Indirect or consequential damages
• Downtime caused by force majeure events
• Third-party service failures
12. Policy Modifications
We reserve the right to update or modify this policy at any time without prior notice. Continued use of our services constitutes acceptance of the updated policy.
